Saharareporters investigations have revealed that the fear of mass uprising and breakdown of law and order in Anambra and neighboring states led the five-judge panel of the Enugu Division of the Court of Appeal to cancel its plan to sell the governorship of Anambra State to Emmanuel Nnamdi (Andy) Uba in exchange for millions of dollars in bribe.
Mr. Uba, who stole billions of dollars while serving as a domestic aide to former President Olusegun Obasanjo, has made relays of trips to various courts trying to buy his way to the governorship. In 2007, Mr. Obasanjo and Professor Maurice Iwu, fraudulent chairman of the Independent National Electoral Commission, foisted Uba as governor after an election that was universally described as one of the worst in history.
As a sign of his confidence that today’s ruling would go his way, Mr. Uba had hired an Ijele masquerade and the Atilogwu, Nkpokiti and Igba Enyi dancers as well as loads of mercenary “supporters” whom he transported to Enugu to “stage a celebration once he was declared ‘governor-in-waiting,’” according to two sources within his close circle. The cultural troupes had to return empty handed as the court adjourned seating till Friday November 13 2009.
A source close to one of the justices hearing the case disclosed that reports by Saharareporters about the scandalous arrangement had thrown the panel into confusion.
A security source with the State Security Service (SSS) also told Saharareporters that the case had generated such a charged atmosphere that the agency dispatched a report to Aso Rock warning of possible widespread violence should the court follow through on its plan to enthrone Uba as reported by us. “We feared that there might be serious trouble in Anambra, Enugu and Ebonyi states,” said the source.
In the wake of the appellate court’s corrupt deal with Mr. Uba, a secondary school failure who falsely claims to possess a PhD, former Biafran leader, Emeka Odimegwu Ojukwu, last week warned that the imposition of Uba could precipitate war. The SSS source said that Mr. Ojukwu’s warning had sharpened the tense atmosphere, adding that even though the Inspector General of Police moved in a major contingent of police officers throughout Anambra, the security agents remained fearful that they would not be able to contain the spate of violence likely to follow any pro-Uba verdict.
A relative of Justice Ngwuta, who hails from Ebonyi, had told Saharareporters that his community had received warnings that both the justice as well as his relatives would face reprisals if the court announced Uba as a so-called governor-in-waiting. The relative said one of the anti-Uba groups “told us to notify Justice Ngwuta that he will be made to pay for installing Uba even if he flies off to the sky to spend the money he has collected from Uba.”
Tension was palpable in Anambra state as the Nigerian police flooded the state with special anti-riot policemen sent in from Abuja. Another contingent of heavily armed policemen camped outside the tribunal in Enugu with an armored personnel carrier. Our reporter on the scene said the policemen did not seem aware that today’s session was cancelled.
Justice Ngwuta, head of the five-person panel of justices, has a bizarre precedent of reversing a Supreme Court ruling. He is a principal player in the scheme to smuggle Uba into office. Others involved in the plot are Uba’s lawyer, Wole Olanipekun, retiring President of the appellate court, Justice Umaru Abdullahi (to whom the bribe money has been entrusted to be disbursed to cooperating justices after the announcement of the verdict), and Maurice Iwu who was nominated for the INEC post by Uba.
A source at the Presidency in Abuja told Saharareporters that the security reports emanating from the Southeast forced Aso Rock to reach the President of the Court of Appeal, Umaru Abdullahi, and request that he signal the panel not to seat today as planned. Hence appeal panel led by Justice Ngwuta postponed its sitting.
Saharareporters also learned that two of the judges involved in the deal also chickened out from a meeting scheduled for Enugu last night to finalize the ruling. Justice Jean Omokri sent in word that he had diarrhea while Justice Aboki detoured to Owerri where he claimed that he would be attending the valedictory event being held for Abdullahi, the court’s outgoing president.
A judicial source told us that Justice Abdullahi’s presence in Owerri was part of a calculated plan “to be near the theatre of action and to remotely control the Uba deal.” Abdullahi, whose notoriety for corruption has earned him the widespread derision of many lawyers, is said to have embraced the Uba deal as an opportunity to reap a huge financial windfall just before his exit from the court.
A source within the court told Saharareporters that Justice Ngwuta was livid with rage when he found out that two of the justices with whom he had cut a deal to read a majority decision in favor of Uba refused to show up at the final judges’ conference. Afraid that he was being set up to take the hit from the controversial case, he alerted Uba’s lawyer, Mr. Olanipekun, a Senior Advocate of Nigeria, who had set up the entire deal.
Olanipekun did not show up in court today after Justice Ngwuta forewarned him that the verdict could not be delivered today as scheduled.
