JUST IN: The Nigerian house of representatives has just passed a resolution transmiting power to Jonathan Goodluck as the "Acting President and the Commander-in-chief of the Nigerian armed forces" . The house resolution was passed a few hours the Senate passed a similar resolution.
The Nigerian senate today resolved, in a near unanimous decision, that Umaru Yar'adua's deputy, Goodluck Jonathan take over as "Acting President and the Commander-in-chief of the Nigerian armed forces" until such a time that Yar'adua returns from medical treatment in Saudi Arabia and transmits a letter indicating that he is medically fit to resume his duties.
More to come...

... Fake!,Fraud! Sham and a shame! In Nigerian parlance this is a 419 decision. I am not a legal luminary nor do I claim to be versed in Legal issues, but Common sense dictates to me that there is a recipe for getting things done. In our case, constitution is the recipe. Instead what we get is a concocted solution all in an attempt to ensure that Goodluck is standing on one foot. If YarAdua really signed the supplementary budget, what stops him from just appending his signature to this letter? Something is not right with this hurried turn around of the House of Rep. decision. Somebody is hiding something. What stops the same assembly tomorrow saying Goodluck, your luck is out! A cashcow for the Assembly men? This is simply a political solution. Very Nigerianese! A shame! |

... The constitution says a written declaration not letter and the Senate is telling us, they have the power to take the president's text message, email, or interview with BBC as his declaration. If Aondoaka and his likes feel that the BBC interview which all the President Aides confirmed was from him and BBC+ print media in Nig published on their website cannot be used as the president’s declartion, let him tell the lawyers in his chambers to go to n court. At the least we will have an acting President that is empowered by the Legislators to sack any minister including Aondoaka. So Aondoaka might end up completing the pursuit of the case from his chambers which he has been using to defend the most corrupts, but not as AGF of Nig. If military topple the govt bcos of court cases that Aondoaka’s boys will initiate, so be it. It means the President and the VP can choose to abide by or ignore such resolutions, and the whole thing may turn out to be a charade. Please read his two comments again and think critically. |

... Gentlemen, it is important to note that the constitution did not envisage the current situation. However, a collective reading of that document will show that it is meant to ensure order and good govt. In a situation like this, there must be an ingenious way to ensure that this core purpose of the constitution is maintained. That 'ingenious’ way is, in this case, the doctrine of necessity under which the senate purports to have acted. It is a noted principles of constitutional law known the world over and have been used in certain places. The senate or the lawyers among them knew that principle and should have acted long time ago. To Ahmed, you are making a mistake of tribalising this decision. You are no more northerner than those northerners who took the decision. You are being myopic when broad mindedness is required. |

A binding resolution, recognised by the constitution, is for the FEC to come out openly and declare UMYA incapacited. This will then make Jonathan's ascension LEGAL. The alternative is for NANS to impeach UMYA. This alternative option is not necessary. So, we are still waiting for the right thing to be done. I will like to use this opportunity to say a big thank you to SNG, the Elders Group, Media Houses, Nigerians that heeded the call and went into the street to make that all powerful statement: Enugh Is Enough, SaharaReporters, my fellow SR commenters, the list goes on... A mere motion does not have basis against the constitiution. The are procedure lay down before Goodluck can become acting : 1. If FEC declare Yaradua Unfit. they passed there resolution and transfer it to senate president who then set up medical board. if the medical board upon there investigation declare Yaradua unfit, then Jonathan can act. 2.If Yaradua can transmit a WRITTEN letter to National assembly that he is on whatever vacation be it medical or anytype of vacation. Note that that letter must be written and not verbal then Jonathan can act 3. Impeachment by National assembly. 4. Death or resignation of Mr President Unless all the above scenarion happen Goodluck Jonathan can never be a acting President. I just advise Jonathan to watch his back. It may be a SET UP. |

However, whether you accept Jonathan or not the time has come when Southerners will also not accept Northern president. The solution is for us to divorce from this illegal and forceful marriage. Then you can accept who ever becomes your president in the desert while we manage our God-given southern progressive country. Look at Chad, Niger etc, they will be your neighbours and you become like them, animals. |

Well if you don't like the resolution, the lagoon is big enough to contain you. But know it that God is at work in Nigeria and has a way of removing evil rulers from us. ... Those who feel this has no backing of the constitution should read the constitution in context. If the president cannot write but can speak to the NASS and of course to Nigerians (which makes it even more transparent that we all heard him say he cannot say when he will return as that decision was in the hand of his doctors), the resolution formalises the verbal transmission of the message by the president to all Nigerians. Agree that it took the intervention of the people before the Senate arrived here but it is better late than throw us into disintegration. Jonathan should immediately sack Aandoaka and other members of the so called kitchen cabinet and investigate their ignoble role in deceiving the entire nation concerning the president's health status. He owes the people who championed his being sworn in electoral reform that will guarantee free and fair election. God bless Nigeria. |

If the FEC does not make a proclamation that UMYA is not fit to continue leading, then the act of the NASS can be contested in court. The NASS says that since UMYA 'failed' to transmit the letter but rather chose to speak to the BBC, that they are relying on an interview with BBC to invoke some constitutional powers to make Jonathan acting president. Are the grounds they gave not enough to Impeach UMYA, for bringing about a situation that threatens peace, order and good government in Nigeria? Nigerians, open your eyes! Don't rejoice yet! He claimed his administration is all about 'rule of law'; he swore an oath, placing his hand on the Kur'an, to uphold the constitution. But he blatantly refused to do so even when for 80 days Nigerians cried to the high heavens, begging him to walk the path of 'honour and morality'. He has therefore committed an impeachable offence, and anything other than his impeachment should be rejected. We must insist that the national assembly impeach him! |

... I see the northern military taking over. This is a repeat of the 1993 plot. Put Sonekan and topple him after some days to return power back to the north. Put Jonathan there, create artificial crises, and take power through coup. Dismantle and ban all political parties, ban senates and reps, dissolve all state assemblies and sack all governors, then the northern power brokers will be back fully to destroy the country. Nigeria!!! Why cant the senates impeach the halve dead man? I see war, serious war looming!!! This time, oppressed Nigerians will resist you(north) in this game of power at all cost. |

Why did it take the Save Nigeria Group led by Pastor Tunde Bakare and Wole Soyinka, the Civil Society, NBA, former Heads of State, the South South Elders Forum, the Ohaneze Ndigbo, Newspapers Proprietors, the entire Nigerian Media, the ordinary people on the streets, Nigerians in the Diaspora, etc for these so called 'Distinguished Senators' who are paid with our money, this long to do what they were supposed to have done ages ago? They should be ashamed of themselves. Nigerians are certainly NOT impressed by this 'show to save their ugly faces' to disappointed Nigerians. They should all go and bury their heads in shame. |

... The Senators hide under the constitution that says the president shall transmit to the senate a letter and said they assumed that the interview Umaru granted BBC is a kind of letter that he his not fit and they also said when Umaru comes back he will inform them that he is back to continue as president. For me i don't see any sense in what they did as Jonathan can be acting on his own, 'cos Some even said what they are doing can be challenged in a court of Law as it is not in the constitution to make Jonathan an acting President without a letter from the president. For me time will tell, I think what is right for them is to impeach Umaru 'cos he failed to transmit a letter. What they did for me is effort that can't scale through if tested in the court of "LAW". I watched the proceeding live on AIT. |

... @Soprinye Jaja, please Ahmed is right. It is not a matter of whether Yardua is above Nigeria, the issue is going about matters in accordance with the Law and to the dictate of a few people. The constitution says the VP can only assume the seat of the President thru: 1. transmission of a letter from the President to both houses informing them of absence or incapacity; 2. Declaration of the President as incapable of discharging his duties by reason of incapacity by the ECF 3. or impeachment by the both houses. QED. anything short of these is a greek gift contrived to over reach the hand of the VP. |

... Why do these Senators like confusing themselves? Why couldn't they wait for the FEC to deliberate? Did they suddenly realise another part of the constitution that empowers them to take such a resolution? If the intent for the resolution was genuine, why did they not impeach Yar'adua on grounds of incapacitation, rather than creating another constitutional anomaly? Is this another gimmick that will send Aondoakaa to court to question the jurisdiction of the senate to pass such a resolution? I smell "FISH" and a big one for that matter. |

Andoaaka declares the move unconstitutional, Bankole refuses to follow suit, the cabinet splits as more move over to Dora's side, we have complete log jam, a constitutional crises and the Generals make their move(which is what the Caliphate want in order to retain power in the North)The next few days are critical. |

Does the president has any constitutional right to hold the whole country in to stand still for 3 months? We only have a team of Cowards and selfish people as our politicians. That was why for over two months ,they could not act according to constitution................even the so called 'Attorney general &Justice minister'. ... Is this not another layer of illegality? I expect the AGF to contest the resolution in court if really he is out to defend the constitution. Why can.t do the right thing by following the steps prescribed in the constitution. Has the president transmitted a letter? on what basis did they base their action? The right thing to do is I believe to invoke section 146 which deals impeachment since the proper step is yet to be taken. In the alternative, they should wait for the ECF or FEC to declare the president permanently incapacitated, they can then act |

The only way that the constitution of Nigeria recognizes an acting president is when the president 'transmits a letter'. Otherwise, Jonathan will have to assume the position as substantive president through action of the Executive council of the federation or impeachment by the legislature. I find it hard to believe that more than 50 old and expereinced men in the senate can sit and pass such a useless resolution. |
